1. Acceptance of Terms

By downloading, installing, accessing, or using TheBabySteps (the "Application") published by KCO Apps ("we", "us", or "our"), you agree to be legally bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not install or use the Application.

2. Important Pediatric & Medical Disclaimer

The milestones, routines, schedules, and activities suggested in the Application are based on general early childhood development guidelines. Every child develops at an individualized pace.

• Never disregard, delay, or avoid seeking professional medical advice or pediatric diagnosis because of something you observed, tracked, or read in TheBabySteps.
• If you have concerns about your child's physical growth, speech progression, cognitive milestones, sensory processing, or health, promptly consult a licensed pediatrician or healthcare professional.
• In a medical emergency, call your local emergency medical services immediately.

3. Parental Supervision & Activity Safety

All physical play, craft projects, sensory walks, and gross-motor challenges suggested in the Application require active, undivided parental or adult caregiver supervision at all times.

• Parents and guardians are solely responsible for ensuring the safety of the environment, equipment, materials (e.g. choking hazards, sharp objects, allergic substances), and physical readiness of the child.
• Modify or discontinue any activity immediately if you believe it poses any discomfort, danger, or hazard to your child.

4. License Grant & Permissible Use

Subject to your compliance with these Terms, KCO Apps grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and execute TheBabySteps on Apple devices that you own or control, solely for personal, non-commercial family use.

You agree NOT to:

• Decompile, reverse-engineer, disassemble, or attempt to derive the source code or proprietary scheduling engines of the Application.
• Copy, modify, redistribute, sublicense, sell, or rent any portion of the Application or activity catalog.
• Use the Application in any manner that violates applicable local, state, national, or international laws.

5. Intellectual Property Rights

All content, features, visual interfaces, graphics, software code, milestone algorithms, Mom and Dad playbooks, trademarks, and design architecture of TheBabySteps are the exclusive property of KCO Apps and are protected by copyright, trademark, and other applicable intellectual property laws.

6. Disclaimer of Warranties & Limitation of Liability

The Application is provided strictly on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise.

To the maximum extent permitted by applicable law, KCO Apps and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including any injuries, developmental discrepancies, or data loss arising out of or related to your use of or inability to use the Application.

7. Apple App Store Terms (EULA)

You acknowledge that these Terms are concluded between you and KCO Apps only, and not with Apple Inc. Apple is not responsible for the Application or the content thereof. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever.
